What Phillips Law Group provides to Defendants Charged with Crimes
-
Advise clients of the elements and defenses to the charges they are facing.
-
Review documents, body-worn video, forensic reports, and conduct interviews with witnesses to determine the most important facts in each case.
-
Provide a detailed explanation of how the criminal justice process works, touching on the issues of burdens of proof, warrants, grand juries, indictments, jury trial rights, hearsay rules, and other important concepts on a case-by-case basis. Every client's case is different.
-
Demand and analyze the evidence provided by the State, looking at the case from legal, strategic, and Constitutional viewpoints. Criminal Procedure is integral to the criminal justice process and we make sure the law is followed.
-
Subpoena documents or witnesses for your case. Provide proof of an alibi or other facts that were previously unknown to law enforcement or state attorneys.
-
Negotiations with the State Attorney assigned to your case to determine all options. When possible, we can help you obtain dismissal of charges, placement on stet docket, or Probation Before Judgment.
-
When appropriate, help clients have their charges handled on a special docket, such as Veterans' court, drug court, or mental health court. We make sure clients know what is involved and what the advantages and disadvantages are with these dockets.
-
Some Defendants may be able to obtain consideration for their case by entering into an agreement to "proffer" information to law enforcement to enable them to solve other crimes. When possible, we will help you understand those opportunities.
-
Prepare a defense strategy that takes into account the theories prosecutors will use, what a judge or jury needs to hear, and what a judge would consider at sentencing. (All of these are key parts of criminal procedure.)
-
Communicate to clients, including visitation with clients while in custody.
-
When appropriate, we help prepare clients for court by helping them locate treatment programs, arrange restitution, or helping them understand the benefit of character witnesses.
-
Secure pre-trial rights by filing a Habeas Corpus motion or attending bail review.
-
Secure post-trial rights by requesting modifications or probation terms or fees, where appropriate.
